- Retainer Agreement :
a. Our retainer agreement, provided by AVIXEN, sets forth the terms and conditions specific to your specific service agreement. It includes details such as duration, rates, insurance coverage, responsibilities, and any additional charges. By contracting with us, you agree to abide by the terms outlined in the retainer and service agreements. - Reservation and Payment:a. To secure your reservation, a booking deposit is required at the time of reservation. The remaining balance is due prior to the start of your service period. We accept various payment methods, including credit cards and electronic transfers.b. Cancellations and refund policies are outlined in the retainer or service agreement. Please review them carefully to understand your rights and obligations.
- Client Requirements:
a. To engage in our services you must be of legal age to agree to the contractual agreements.
b. Client must ensure all funds will clear the bank before service begins. Any delays inopayment willdelay your services.
c. Clients may pay hourly for services while awaiting banking to clear at a 5 hour miniumumn. - Retainer hours:
a. Services are provided on a hour by hour basis.
b. Your service contract will determine if any unused hours will roll over to your next quarter. - Outside contracted work:
a. Clients are responsible for paying for all reccommended 3rd party work directly. Under no circumstances will work be subcontracted unbless it is decalred in writing as part of the engagement documents. - Liability and Insurance:
a. Clients are responsible for any loss or damage resulting in actions taken after consulting wiht us.. We have our own general liability insurance, However for your protection, and it is recommended that you obtain adequate coverage.
b. AVIXEN and any of it's associates shall not be liable for any personal injuries, accidents, or damages that occur during the engagement period.
c. If AVIXEN is asked to go on premesis, it will be the responsibilityof AVIXEN associates to be fully insured for transportationonly to and from the premesis
d. If AVIXEN associates enter a client;s premesis the client must be fully insured for any health or safety issues that coudl occur on premesis.
e. AVIXEN associates reserve the right to refuse to enter any premesis that they deem to be unsafe for any reason. - Limitation of Liability:
a. AVIXEN shall not be liable for any indirect, consequential, or incidental damages arising from the use of our services , tools, or systems.
b. In the event of unforeseen circumstances, such as mechanical failures or unforeseen events, AVIXEN will make reasonable efforts to provide suitable alternatives or compensation. - Privacy Policy:
a. We value your privacy and handle your personal information in accordance with our Privacy Policy. Please refer to our separate Privacy Policy for more details. - Governing Law:
a. These terms and conditions shall be governed by and interpreted in accordance with the laws of the jurisdiction whereAVIXEN is registered. - Returns and Refunds:
Returns of goods are processed with a written return merchandise authorization letter from Avixen management.
Refunds of services are only processed with a written letter from Avixen management
All returns and Refunds are issued as credit towards future goods or services. - Credit disputes
Credit Card disputes must be negotiated in good faith directly between client, or customer and Avixen management - Avixen reserves the right to refuse service to anyone for any reason
